Terms of Use

These terms describe the basic rules for using The Pull Club, including digital collectible pack purchases, adult-age access controls, creator content, and account features.

Digital Collectible Packs

The Pull Club lets users browse creator sets, purchase or receive digital pack access, open packs, and view unlocked digital cards in a collection.

The primary pack format is a digital set booster pack. Unless a checkout page says otherwise, each set booster contains 10 digital cards: 6 common cards, 3 uncommon cards, and 1 rare-slot card that may be Rare or Ultra Rare based on the odds disclosed for that set before purchase.

Limited serialized Ultra Rare cards, when offered by a creator set, are part of the Ultra Rare side of the rare slot and may have a fixed maximum number of copies. Set completion reward cards, when offered, are promotional completion rewards and are not guaranteed inside ordinary pack openings.

Digital cards, unopened packs, favorites, binders, and trades are app features only. They do not represent cash, stored value, securities, gambling winnings, or a promise of resale value.

Digital cards and unopened packs are licensed for personal in-app collection, display, and platform-provided trading features only. They have no cash value, are not investment products, and cannot be resold, redeemed, wagered, or cashed out through The Pull Club. The Pull Club does not provide a marketplace, buyback program, redemption program, or cash-out feature.

Digital cards, unopened packs, collection binders, clubs, trade tools, rewards, limited serial numbers, and related app features are limited, revocable, non-exclusive, non-transferable service licenses. Users do not receive ownership of any underlying artwork, images, software, platform records, creator content, or intellectual property.

The Pull Club is not intended to be a gambling or wagering service. Users do not stake money for a chance to win cash or cash-equivalent prizes from The Pull Club.

Purchases and Payment Processing

Purchases may be processed by third-party payment processors, including Epoch, Segpay, or another hosted checkout provider. Checkout screens may show processor names, transaction IDs, fees, taxes, currency conversion, and delivery details.

Pack purchases are one-time digital purchases unless a checkout page clearly says a subscription or recurring charge applies. Any future recurring product must disclose the billing period, renewal amount, cancellation method, and processor billing support before payment.

When a hosted payment processor handles a payment, that processor may provide billing lookup, receipts, refunds, and payment-card support. The Pull Club support can inspect account delivery records, pack delivery, and app-side purchase history.

Users must provide accurate payment and tax information. We may keep transaction, tax, support, and delivery records needed to operate the service, respond to disputes, and meet reporting obligations.

Accounts

Users are responsible for keeping account credentials private and for activity under their account.

By creating an account, users agree to these terms, the privacy policy, and any checkout, creator, trade, support, or content rules shown in the app.

Users may not scrape, crawl, harvest, reverse engineer, decompile, copy, or use automated tools to duplicate The Pull Club, its workflows, pack logic, trading logic, database structure, designs, or business functionality, including attempts to use artificial intelligence tools to clone or reproduce the service.

Users may not download, save, copy, screenshot for redistribution, scrape, train models on, sell, publish, or otherwise misuse card images, creator images, set images, pack artwork, or other user/creator content except through the collection, sharing, trading, or display features intentionally provided by The Pull Club.

Users may not sell, auction, broker, escrow, advertise, or otherwise arrange off-platform resale of digital cards, unopened packs, accounts, creator access, referrals, or trades.

The Pull Club may suspend or terminate accounts for repeat copyright infringement, repeated rights complaints, or abuse of DMCA notice and counter-notice processes.

Creators are responsible for the sets, images, names, sale windows, and descriptions they upload or publish through creator tools.

Account Suspension, Termination, and Access Changes

The Pull Club may suspend, restrict, terminate, disable, delete, or modify access to accounts, purchases, unopened packs, opened packs, digital cards, collections, binders, trades, creator clubs, creator access, payout access, or other app features when we believe it is necessary to protect the service, users, creators, payment processors, rights holders, legal compliance, safety, fraud prevention, moderation processes, age-verification requirements, or enforcement of these terms.

Account action may be taken for suspected or confirmed fraud, chargebacks, payment abuse, account sharing, underage access, failed or revoked age verification, prohibited content, rights or consent issues, scraping, automation, security probing, resale activity, harassment, evasion of moderation, illegal activity, processor requirements, or conduct that creates legal, safety, financial, reputational, or operational risk for The Pull Club.

If an account is suspended, terminated, deleted, or restricted, access to digital cards, unopened packs, collection features, clubs, trades, creator tools, support tools, or other app features may be limited or lost. Digital items are service features and limited licenses, not property, stored value, cash, securities, winnings, or redeemable assets.

The Pull Club may preserve account, transaction, delivery, collection, moderation, content, complaint, verification, tax, payout, fraud-prevention, and support records as needed for legal compliance, accounting, security, chargebacks, processor rules, dispute handling, enforcement, or audit purposes, even if visible account access is limited or removed.

Where required by law, processor rules, or our posted policies, The Pull Club may provide notice, an opportunity to appeal, restored access, a refund, a credit, or another remedy. Nothing in these terms limits any non-waivable consumer rights that apply in a user's location.

If a set, card, or creator shop is banned, delisted, suspended, or removed after a user has unopened packs from that set, The Pull Club may disable opening, substitute replacement content, issue an account credit, provide a refund when legally required or approved by support, or take another action we determine is appropriate for legal, processor, rights, safety, or technical reasons.

Creator Content Responsibility

Creators are responsible for having the rights, releases, permissions, and licenses needed for uploaded images, names, logos, likenesses, trademarks, generated images, AI-assisted images, and other content.

Creators may not upload content that is unlawful, exploitative, infringing, deceptive, non-consensual, defamatory, privacy-invasive, or prohibited by payment processor rules. This includes content involving people, teams, schools, brands, logos, uniforms, locations, copyrighted work, trademarks, or likenesses unless the creator has the legal right to use it.

Creators may not upload or market content involving minors, child sexual abuse material, non-consensual activity, forced or illegal activity, trafficking, incest, bestiality, animals in sexual contexts, violence, choking, exploitation, celebrity or public-figure impersonation, or any other prohibited category identified by The Pull Club, payment processors, card networks, or applicable law.

Creators must verify their own age and identity and must verify the age and identity of every person depicted in adult or age-restricted content. Creators must collect and retain written consent, model releases, distribution permissions, and rights records, and must provide those records to The Pull Club or its payment processors when requested.

Creator rights, model releases, and content licenses should grant The Pull Club and the creator ongoing rights to keep operating, displaying, delivering, supporting, moderating, and recording content already submitted, approved, sold, delivered, unlocked, opened, or added to user collections. A person or rights holder may stop future content from being created or submitted, but withdrawal does not automatically remove rights already granted for valid previously distributed content.

Creators must follow the Compliance / 2257 Statement linked in the footer, including any applicable age, identity, consent, and recordkeeping requirements.

Creator-uploaded sets are subject to pre-publication review before sale. The Pull Club may require creator identity verification, model releases, proof of rights, age/consent records, content records, or additional payment-processor compliance documents before allowing a creator to sell packs.

Creators understand that The Pull Club may review, reject, hide, ban, or remove specific cards, entire sets, creator shops, or creator accounts. The Pull Club may also pause sales, suspend payouts, or preserve transaction and content records when needed for legal, processor, chargeback, moderation, or safety reasons.

Creator and Recruiter Payouts

Creator shares and recruiter commissions are calculated from completed eligible sales according to the app's current payout rules, processor requirements, refund and chargeback handling, and any creator or recruiter terms shown during onboarding.

Payout balances may be subject to a hold period before they become payable. Unless The Pull Club states otherwise in writing, payout rows are held for 30 days after the related sale to allow time for refunds, chargebacks, fraud review, processor review, tax review, or moderation review.

The Pull Club has a minimum payout threshold of $100.00 net payable balance for creators and recruiters. Amounts below $100.00 remain payable or pending in the account records and roll forward until the net payable balance reaches the threshold.

Net payable balance means eligible unpaid creator shares or recruiter commissions after holds, refunds, chargebacks, negative carryover, processor adjustments, account corrections, and any other applicable offsets.

The Pull Club may delay, reduce, offset, suspend, or decline a payout when required for refunds, chargebacks, disputes, suspected fraud, account review, content moderation, missing payout information, tax or compliance records, processor rules, legal requirements, or enforcement of these terms.

Prototype, internal, QA, complimentary, free, test, or otherwise non-commercial transactions may appear in reports for testing but do not create real payout obligations unless The Pull Club expressly marks them as payable in writing.

Indemnification

Creators agree to defend, indemnify, and hold harmless The Pull Club, its owners, operators, service providers, payment processors, and partners from claims, losses, liabilities, damages, costs, and expenses arising from creator-uploaded content, missing or invalid releases, rights or consent disputes, intellectual-property claims, privacy or publicity-rights claims, prohibited content, payout information, tax information, or a creator's breach of these terms.

Users agree to defend, indemnify, and hold harmless The Pull Club from claims, losses, liabilities, damages, costs, and expenses arising from their account activity, misuse of the service, prohibited conduct, fraud, chargebacks, disputes, scraping, resale activity, or breach of these terms.

Disclaimers

The Pull Club is provided on an as-is and as-available basis. To the fullest extent allowed by law, The Pull Club disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, uninterrupted operation, and error-free service.

The Pull Club does not guarantee that any creator set, card, pack, collection feature, trade feature, club feature, payout feature, report, or support tool will remain available permanently, or that any user will receive a particular card, rarity, serial number, completion reward, creator outcome, payout timing, or app experience.

Limitation of Liability

To the fullest extent allowed by law, The Pull Club and its owners, operators, service providers, payment processors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including loss of access to digital cards, unopened packs, collections, creator tools, payout records, or app features.

To the fullest extent allowed by law, The Pull Club's total liability for any claim related to the service is limited to the greater of the amount the user paid to The Pull Club for the transaction giving rise to the claim or $100.00.

Some jurisdictions do not allow certain warranty disclaimers or liability limits. In those locations, the limitations apply only to the fullest extent allowed by law.

Governing Law and Dispute Resolution

Unless a non-waivable law requires otherwise, these terms are governed by the laws of the U.S. state where The Pull Club is organized, without regard to conflict-of-law rules.

Before filing a claim, users and creators agree to contact support and try to resolve the dispute informally for at least 30 days.

To the fullest extent allowed by law, disputes will be resolved through individual binding arbitration rather than a jury trial or class action. Users and creators waive the right to participate in class actions, class arbitrations, private attorney general actions, or representative proceedings, except where that waiver is not allowed by law.

The Pull Club may seek injunctive or equitable relief in court to protect intellectual property, confidential information, platform security, payment integrity, age-verification controls, content records, or service operations.

Age and Content Rules

The Pull Club is intended for users who are at least 18 years old. Users must also be old enough to use the service in their location and to view any creator content they access.

The Pull Club may require third-party age and identity verification before users can access the app, view creator content, purchase packs, receive free packs, or use creator tools.

Adult or age-restricted creator content may not be accessible until the user has completed required verification. The Pull Club may block, limit, or remove access in regions where age verification, adult content, payment processing, or creator content rules cannot be satisfied.

Complaints and Content Removal

Anyone may report content that appears illegal, non-consensual, infringing, unauthorized, misleading, privacy-invasive, age-restricted without proper controls, or otherwise against these terms or processor rules.

Reports can be made through the Complaints & Content Removal page linked in the footer. DMCA copyright notices can be sent to copyright@thepullclub.com. The Pull Club may remove illegal content immediately, investigate reports, restrict sales while reviewing content, and report issues to payment processors or authorities when required.

People depicted in content may request removal or appeal a rejected request. If appropriate consent, age, identity, or rights records cannot be confirmed, or if a release is invalid because of fraud, coercion, underage content, non-consent, infringement, or other legal or processor concerns, the content may be removed or disabled.

Acceptable Use

Users may not upload unlawful content, impersonate another person or creator, interfere with the service, or attempt to bypass pack opening, purchase, collection, or trade logic.

Users may not probe private APIs, bypass access controls, automate pack opening or trading, inspect app data to gain unfair information about unopened packs, evade moderation, or use bots to farm accounts, packs, referrals, trades, or creator sales.

We may remove content, restrict access, or suspend accounts when needed to protect users, creators, payment processors, or the service.
